Para além do fenômeno econômico: regulação social como instrumento de intervenção estatal.

This study aims to analyze social regulation as an autonomous form of state intervention, distinct from the traditionally studied economic regulation. Brazilian legal and economic literature has largely focused on the economic aspects of regulation, especially on market failure correction and efficiency promotion. However, regulation also has a fundamental social dimension, oriented toward the promotion of human dignity, the protection of fundamental rights, and the reduction of social and environmental risks. This research seeks to conceptualize social regulation by highlighting its specific features, objectives, and instruments, based on a qualitative approach using legislative, bibliographic, and jurisprudential sources. The study intends to contribute to the development of a theoretical framework that legitimizes and strengthens the role of the regulatory state in social matters, aligned with the construction of a fairer and more inclusive society.
