Análise Econômica do Direito e o Anteprojeto do Novo Código Civil

The research carried out during the 2024–2025 PIBIC cycle examined the punitive dimension of civil liability in Brazilian law through the lens of Economic Analysis of Law (EAL), while engaging in comparative dialogue with foreign legal systems. The project surveyed theoretical foundations, case law and scholarly debates to assess whether sanction-oriented tools—such as punitive damages—can be incorporated into a framework traditionally focused on compensatory relief. The analysis considered their alignment with efficiency, deterrence and effective victim protection
