Abstract
This study aimed to analyze the positions adopted by states in their written submissions presented in advisory proceedings before the International Tribunal for the Law of the Sea, the International Court of Justice and the Inter-American Court of Human Rights, regarding state obligations in the face of climate change. In particular, the proposals and arguments of Latin American countries and those belonging to the "Global South" were examined to understand how they respond to contemporary challenges and how they assign importance to the individual initiatives of each State. To this end, a mixed methodology was adopted, combining quantitative and qualitative approaches in the analysis of documents submitted by their representatives, as well as the jurisprudence of the courts and tribunals under study. The results indicate that most countries adopted a proactive stance, aimed at strengthening their international obligations and relations, protecting the marine environment, monitoring greenhouse gas emissions, and mitigating damage to marine ecosystems through international cooperation.
